Terms and Conditions

Dear User, you are advised to carefully review the terms and conditions (Terms and Conditions hereinafter) set forth herein, by which the Ministry of Tourism allows access and use of the Website “Tesoros de México”. By accessing or using, any of the Web pages which conform this Website (“Site”) you acknowledge that you have read and understood these Terms and Conditions.

CONDITIONS

If you do not agree with the Terms and Conditions, you will not be able to access the Site or you will have to immediately stop its use.

1. PURPOSE OF USE AND RESTRICTIONS.

Visiting or using the totality or any portion of the Website User agree to be bound by the Terms and Conditions set forth. On this Website, User will be granted with access and/or use of all services and content (“Services and Contents” hereinafter), provided by The Minister of Tourism and/or third parties. The Ministry of Tourism reserves the right to deny, limit or condition the access to the Website to any User at its own discretion and without liability, or as to totally or partially modify the Services or Contents of the Site at any moment and without notice.

The User recognizes that not all the Services and Contents may be available in every country or location and that some Services and Contents will only be available after registration of the User and/or payment of a fee in accordance with the information provided in Section 12 (“Particular Conditions”).

The Ministry of Tourism does not warrant that the Site, Services and Contents or any other service related to a specific activity will operate error-free. The Site, its content and material and access to the data, are all provided on an ”as and when available” basis without any representations, guarantees, conditions or warranties of any kind.

The Ministry of Tourism does not take responsibility for any damage or loss of any kind caused due to the unavailability or improper function of the Site and/or Services and Contents.

2. INTELLECTUAL PROPERTY.

All rights regarding services, contents, site domains, title and any other distinctive signs; including their use, publishing, reproduction, distribution and transformation are and shall at all times remain the sole and exclusive property of The Ministry of Tourism in its Federal and State jurisdiction. The user will not acquire any intellectual property right through the access or use of the Services and Contents of the Website and that shall not constitute an authorization or license to use them for any other different purpose from the one referred in the current Terms and Conditions.

3. INTELLECTUAL PROPERTY OF THIRD PARTIES.

The user agrees that the dispositions described in the former section (Section 2) regarding the ownership of the Ministry of Tourism, also apply to the intellectual property of Services and Contents which may pertain to a third party.

4. LICENSE.

The user is granted full responsibility for the uses of Services and Contents of the Site which shall be used accordingly to the functionality given by the own Website and only under the authorized uses thoroughly described in these Terms and Conditions, therefore the User agrees to use such content diligently,  following moral standards, and in accordance with the normativity of Internet use, United Mexican States Law  and current federal regulations pertaining to the country where the user shall be. Any commercial use or copying of any of the content other than for the purpose expressly permitted herein is contrary to these Terms and Conditions and not permitted.

5. LIMITATION OF RIGHTS.

The User does not have the right to place hyperlinks from or on the Website, nor the right to use the Services and Contents of the Site on their own or a third-party website without prior and written authorization of the Ministry of Tourism. In addition, the User does not have the right to set limitations or restrictions to any other user of the Website.

6. QUALITY OF THE SERVICES AND CONTENT.

Neither The Ministry of Tourism, nor its providers or other commercial partners shall be responsible for the damages or harm suffered by the User due to inaccuracies, typographical errors, changes or improvements made periodically to the Services and Contents. Recommendations and advice provided through the Site are of general nature, therefore must not be taken into account for any decision-making about personal matters. User shall consult with the appropriate professionals about their specific needs.

7. GOODS AND SERVICES SUPPLIED BY TIRD PARTIES.

Regarding Services and Contents supplied by third parties in the Site or by linked websites (hyperlinks, banners and buttons), The Ministry of Tourism limits itself exclusively, for the user convenience, to: (i) inform the user about them, (ii) offer a means of connecting users and service providers. Products and/or services which are commercialized inside the Website and/or by third-party linked websites are supplied by independent traders, not related to the Ministry of Tourism.

The Ministry of Tourism is not and shall not be considered a supplier of the goods and/or services offered through those sites. The inclusion of those links/webpages shall not constitute nor imply approval, support, sponsorship or recommendation on the part of the Ministry of Tourism of the goods and services traded in them, nor responsible for their Contents. There is no financial, business, employment or other relationship between The Ministry of Tourism and those parties. Any advice, assessment, statement, information and content related to third parties linked into the Site, do not reflect those of the Ministry of Tourism; thus, it will not be liable for any direct or consequential harm or damage suffered by the User, including but not limited to the loss of programs or electronic information.

8. CONFIDENCIALITY.

By accessing and using the Site, the User authorizes the Ministry of Tourism to use, publish, reproduce, disseminate, communicate publicly and transmit the non-confidential information in compliance with article 109 of the Federal Copyright Law and fraction I, article 76 bis of the Federal Consumer Protection Law.

9. COOKIES.

By accessing and using the Site, User consent to receive the cookies which are transmitted by The Ministry of Tourism servers. “Cookies” are files that are stored in the hard drive of user´s computer when they access a web server through a website. Cookies can be used by web servers to identity and track users as they navigate different pages on a website, and to identify users returning to a website. Cookies are unable to read the data or information from the user´s hard drive or the Cookies created by other sites or pages.

10. PASSWORDS AND CONFIDENTIAL NUMBERS.

At all times, the User is solely and total responsible for maintaining the secrecy of your password, keywords, or any account information to access the services and contents of the Site and third-parties websites.

11. MODIFICATIONS.

The Ministry of Tourism reserves the right to partially or totally modify the Terms and Conditions and Privacy Policy herein without prior notice. In consequence, the User shall read carefully these Terms and Conditions and Privacy Policy every time the Website is accessed. Certain Services and Contents offered on/and through the Site are subjected to their own particular conditions (“Particular Conditions” hereinafter) which may substitute, complete and/or modify these Terms and Conditions and Privacy Policy. Consequently, the User shall read carefully the corresponding Particular Conditions before accessing to any of the Services and Contents.

12. JURISDICTION AND GOVERNING LAW.

For the interpretation, enforcement and implementation of the present Terms and Conditions, User agrees that these Terms and Conditions shall be governed by and construed in accordance with the laws of the United Mexican States. User irrevocably consents that any legal action or proceeding against it with respect to these Terms and Conditions shall be brought in the federal courts of the United Mexican States located in Mexico City and accepts with regard to any such action or proceeding, generally and unconditionally, the jurisdiction of the aforesaid courts, and User hereby waives, to the fullest extent permitted by law, any right that it may have to claim that any such action or proceeding be brought in a different jurisdiction to which it may be permitted under law, its domicile or for any other reason.
